Terms of Use – Weiss Group

General

Welcome to Weiss Group’s Website (hereinafter: The Website). The site is owned by Weiss R.Y Real Estate Investments Ltd. PC 515300259 (hereinafter respectively: The Website, The Company) and is operated by them for them and for the Weiss Group. (Hereinafter: The Group)
The site is used as an interface for direct contact between Group customers and/or site users (hereinafter: Users) and the Group, through which Users can receive comprehensive information about the Group and the services they provide, and the various projects they undertake. (Hereinafter: Group Services).
Please be sure to review and these terms of use and its updates, as the very use by any user and/or person and/or entity browsing and/or viewing and/or using the site in any other way, directly or indirectly, including any content and/or service therein, constitute consent by users to the Terms of Use of the site, including the terms of the Privacy Policy (hereinafter: Privacy Policy) which can be viewed, as updated from time to time (hereinafter: Terms of Use), without any restriction and/or reservation. The Terms of Use and privacy Policy regulate the relationship between users and the Group and may change from time to time in accordance with the Group’s sole and exclusive discretion. Therefore, prior to executing any action on the site, users are asked to carefully read the Terms of Use, including the Privacy Policy.
The Group reserves the right to change, delete or add to these Terms of Use at any time, without prior notice beyond publishing the provisions in the Terms of use themselves. Any addition and/or change made to the site, its contents and/or these Terms obligate site users by their continued use. Therefore, the Group recommends users read the Terms from time to time. Use of the Website following any such changes constitutes consent to the changes. Insofar as users do not consent to the changes, they must avoid continues use of the site.
The binding and determining version at any time is the one published on the site. The Terms of Use and Privacy Policy are cumulative and do not come to replace each other, and they shall be construed as coexisting and not derogating each other. It is clarified that users may choose to peruse some of the information and/or products and/or services offered on the site or all of them. Furthermore, some services offered on the site may be inactive and will be offered to user when they become active.
Use of the male form in the Terms of Use is for convenience only and the Terms apply to all genders.

Restrictions for Use of the Site

Users are prohibited from carrying out the following actions and/or deeds when using the site and its contents, without prior written consent of the Company:
- Make any commercial use of the site and/or its contents.
- Copy, reproduce, modify, translate, reverse engineer, distribute, transmit, display, perform, duplicate, publish and save the site’s contents, in full or in part.
- Activate or enable activation of any computer application or any other means, including software such as Crawlers, Robots, etc., for the purpose of searching, scanning, copying or automatically retrieving site contents.
- Display content from the site in a visible or hidden frame (iframe) or display the site content in any way, including through any software, device, accessory or communication protocol, that changes their original design on the site and/or omits something.
- Disrupt or violate any right of another user of the site, including the right to privacy and/or collect personal information about site users without their express written consent, including by automatic means.
- Infringe on the dignity or privacy of another user and/or use the site and/or its content to harm the good name of any person and/or publish incitement, fraud, deception, defamation and/or any other information that is false, unreliable or that may intentionally harm.
- Use the site or its content to create a database and/or collection.
Violation of these restrictions may cause users from being restricted from using the site and also expose them to civil and/or criminal liability, in accordance with any law.

Using the Site and Information

Use and entry to the site, including the mailing list and/or ways of contacting the Group as well as use of information provided by users to the Company and/or accumulated about them when using the site and/or received from a third party in accordance with users’ permission (for example, in connection with a particular project in which the Company has business partners), will be carried out in accordance with the provisions of the law and the site’s Privacy Policy, which is an integral part of the Terms of Use.
Users must ensure to provide correct and true details about themselves and about any other third party, if required. It is hereby clarified that entering false personal details is strictly prohibited, constitutes a civil tort and even a criminal offense, and doing so is subject to legal, criminal and civil proceedings, including tort claims for damages caused to the company and/or anyone on its behalf as a result.
For the avoidance of doubt, the Group may at any time and at their sole and exclusive discretion prevent users from accessing information on the site and/or cancel their registration on the site, if their behavior is inappropriate and/or they misused the site, including non-compliance with the Terms of Use and/or the Privacy Policy, or any other agreement between the user as a user or other, and the Group.

Ownership and Intellectual Property Rights

The site and the information appearing on it, including design of the site, drawings, designs, illustrations, music, photographs, images, maps, audio clips, videos, text, signs, names, graphics, etc. (hereinafter: Content or Contents) are protected as intellectual property, by Copyright law, trademarks or any other proprietary right, whether registered or not. Users are strictly prohibited from making changes, performing a reverse engineering procedure, copying, publishing, distributing, broadcasting, displaying, performing, reproducing, issuing a license, creating derivative works or selling any part of the content contained on the site without the express consent of the Group, in advance and in writing.
All intellectual property rights related to the site of any kind and type (whether a registered or an unregistered right), including the domain name (Domain), patents, trademarks, trade names, samples, copyrights, trade secrets, methods, manner of presentation and design of the site, and any matter or details related to the site, are the sole property of the Group or of a third party who has allowed the Group use of them, and use of any of said rights is permitted solely to the Group (or other third parties, if they have a license to do so). It is prohibited to copy, distribute, reproduce, sell, translate and/or execute any other action with all types of text and/or code and/or pictures and/or trademarks and/or photographs and/or videos and/or any other content appearing on the site, unless approved by the Group in advance and in writing.
Without derogating from the above, the Group’s name and trademarks, or those of anyone on their behalf, including as they appear on the site, are the sole property of the Group and no use is to be made of them.

Site Content and Advertisements

In the Terms of Use and Privacy Policy the term Content or Content means: any content, including and without prejudice, text, hyperlinks, design, illustrations, images, graphics, software, graphs, sound, video and/or audio, etc.
The Group’s intention is that content appearing on the site will be correct and accurate, however, the content may not be complete and alternatively, technical or other errors may have occurred in the content.
The Group will present information about their projects and services, accurately and correctly insofar as it depends on them and is under their control.
The Group reserves the right, at their full and exclusive discretion, to change the site, and the services within at any time, including by adding, removing, terminating or limiting, changing the structure of the site, the scope and availability of the information and services offered and any other aspect related to the site, in service and operation, without any need for prior notice. It is clarified that users will not have any claim and/or demand and/or suit against the Group in respect of the aforesaid.
The site may display content, publications, advertisements, articles, information, services, products and/or any other content of third parties and/or on their behalf, either by referring the user to third party sites and/or by displaying them on the site (hereinafter: Third Party Content). Without derogating from the aforesaid, users’ use of the content of a third party is subject to the regulations and/or terms of use and/or privacy policy of those third parties, as far as these exist. It is clarified that any opinion, expression of a position, advice, statement, offer, information, service and/or any other content in the content of a third party, belongs to that third party and the Group is not involved in their creation, editing and/or operation.
In addition to the above, the site may also contain links to other websites which are not operated by the Group. These links are intended solely for the convenience and knowledge of users. These links are not controlled by the Group and they do not supervise the content of linked websites. To the extent that the site contains these links, this does not indicate the Group’s consent and/or responsibility for the content appearing on the linked sites and/or constitutes a guarantee for their reliability, their being current, correct or legal and/or the privacy policy and terms of use adopted by their owners. The Group is not responsible for any result that may be caused as a result of using the linked sites and/or reliance on them and recommends carefully reading the terms of use and privacy policy of these sites, if any, and/or contacting the linked site owners in any case of a claim or request in the matter. It is further clarified that the Group may, in accordance with their full and exclusive discretion, remove any link from the site and/or add additional links and that the Group does not undertake that the links to said websites will be active and lead to an active website.
Any use of the site content, including content provided by the Group and/or third party content, including any entry of users to third party sites referred to by the site and/or on an advertisement on the site, will be made at the sole responsibility of users. Users will not have any claim and/or demand and/or suit against the Group in connection with content on the site, including content provided by the Group and/or content of a third party and, including content regarding products and/or services, for any direct or indirect damage, resulting from such use and/or entry and/or due to reliance on third party content and/or due to invasion of privacy following such use. The Group suggests users carry out all their assessments and tests regarding a product and/or service they are interested in purchasing, and in any case, users waive and will be prevented from raising any claim and/or demand and/or suit in the matter.

Liability

The Group does everything in their power to provide users with a quality and safe user experience on the site. However, the site is not immune to glitches and/or problems and you may not have access to the site from time to time.
The Website, including any content and/or service on it, is provided by the Group in their condition as is and subject to their availability (As Is and As Available) – including any information received by a third party. The Group will not bear any responsibility, express or implied, in connection with the site, including any content or service on it, as well as in connection with their suitability for a specific purpose and/or users’ requirements.
Users are solely and fully responsible for any use made of the site, including any content and/or service therein. The Group is not responsible, directly or indirectly, for any use made by users of the site.
The Group, their shareholders, manager and/or anyone on their behalf, shall not bear any responsibility for any damage and/or loss, direct or indirect, including ancillary, consequential, incidental or punitive damages (including, and without prejudice to the generality of the aforesaid, compensation for loss of work and business, loss of profits, interruptions and disruptions to work, losses and/or loss of business information, damage to reputation, and any other loss and/or pecuniary damage), deriving from and/or related to the site, or any content and/or service on it, or any use thereof, including but not limited to: 1) use and/or inability to use the site, including any content and/or service on it, for any reason; 2) messages and/or files received by users during and/or due to using the website, including any content and/or service on it; 3) use or reliance on information and content published on the site, either by the Group or by third parties; 4) Any act or omission of the site content or in regard with it after transfer to a third party; 5) disruptions, availability and integrity of the site, including any content and/or service on it, for any reason, and including, resulting from disruptions or failures of the internet or telephony network; 6) Damage or loss caused by an error, mistake, inaccuracy, etc. in the content on the site.
It is clarified that a disruption in receiving user information on the Group’s computers for any reason, including a fault related to the Group, will not constitute grounds for any claim and/or demand and/or suit on the part of users towards the Group.
Users hereby undertake to adhere to the provisions of any law that may apply to them using the site and/or its content, including these Terms of Use.
User will compensate and indemnify the Group and/or anyone on their behalf, immediately upon first claim, for any damage, loss, loss of profit, payment and/or expense, damage to reputation, economic and/or commercial damage, including by virtue of any claim, suit, ruling, settlement, execution, and including legal expenses, and the costs of legal advice, arising, directly and/or indirectly, from violating the Terms of Use and/or any act and/or omission of users and/or any charge in which the Group and/or anyone on their behalf, for which the Company is not liable for according to the Terms of Use.
The Group may change and/or stop and/or cancel site activities at any time, in accordance with their full and sole consideration without any requirement to give prior notice.
In the event of any discrepancy and/or inconsistency of any kind and type between any content on the site and the Terms of Use, including the Privacy Policy, the provisions of the Terms of Use and/or the Privacy Policy, as the case may be, will prevail.
The limitation of liability in this clause does not derogate from any other limitation of liability in the Terms of Use and Privacy Policy.

Site Hours of Operation

The site is active 24 hours a day, excluding times it is shut down for maintenance and/or for any other reason.
It is hereby clarified that there may be changes to these hours of operation, including the site’s hours of operation etc., and all in accordance with the Group’s sole and exclusive discretion.

Statute of Limitations

Without derogating from the Terms of Use, users are aware, agree and hereby confirm that the statute of limitation for any claim and/or demand and/or suit against the Group will be limited to a period of six (6) months, and the parties regard this as an agreement to the term of the statute of limitation within the meaning of clause 19 of the Limitation Law, 5718-1958.

Jurisdiction, Judgment and Dépeçage

For any use of the site and/or any claim and/or demand and/or suit arising from this use and/or in everything related to or arising from ordering Group products and/or in any other matter directly or indirectly related to the site shall apply only to Israeli law. Exclusive jurisdiction in all matters relating to and/or arising from these Terms of Use shall be vested in the competent court in the City of Tel Aviv-Yafo, and the substantive and procedural law that will apply will be Israeli law, which will prevail over any rules of choice that apply to foreign law.

Miscellaneous

These Terms of Use constitute the entire agreement between you and the Group regarding the manner in which the Website is used and supersede any other understanding and/or consent, oral or written, regarding use of the Website and our content.
If any of the Terms of Use is found to be illegal, void or unenforceable for any reason, this term will be deleted from the Terms of Use and its deletion will not affect the legality and validity of the remaining Terms of Use. In such a case, the existence of a similar term will be seen as enforceable instead of the term that has been deleted or removed.
Any delay, waiver, extension, delay or failure on the part of the Group to exercise their rights and/or demand compliance with any term of these Terms of Use and/or their agreement to deviate from the Terms of Use will not constitute a precedent, will not be considered a waiver and/or consent by the group, and equal derivation shall not be applied to another case shall not be inferred form this.
The Terms of Use detailed above do not create and are not to be considered as creating any partnership, joint venture, employer-employee relationship or emissary relationship between users and the group.

Any message sent by the Group to users according to the address provided by users when ordering will be considered as having arrived in response after 48 hours from the date it was delivered to the post office.
